1. Acceptance of Terms

By accessing, registering for, or using the EntrepriseSite platform (the "Platform"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you may not access or use the Platform.

2. Service Description & AI Site Generation

EntrepriseSite provides an automated AI-driven website generation service and web editing dashboard. You acknowledge and agree that:

• AI-Generated Content: Websites, text copy, styles, layout configurations, and images are generated by artificial intelligence models. While we strive to refine our systems, EntrepriseSite does not warrant that AI-generated websites are accurate, free of errors, fit for a particular purpose, or legally compliant for your specific business niche.
• User Responsibility: You are solely responsible for reviewing, validating, and editing all AI-generated content (including company descriptions, pricing grids, and images) before publishing them or using them for any commercial purposes.
• No Third-Party Liability: We integrate third-party services (such as OpenAI, Google Gemini, and Unsplash) to generate content. We are not responsible for service outages, failures, or content licensing limitations originating from these third parties.

3. Accounts & Subscriptions

To use the Platform, you must register for an account. You agree to keep your credentials confidential and notify us of any unauthorized activity.

• Billing and Auto-Renewal: Paid subscription tiers (e.g., Pro Plan, Business Plan) are billed on a recurring monthly basis. By upgrading, you authorize us to charge your payment method. Subscriptions automatically renew unless cancelled.
• Cancellation Policy: You can cancel your subscription at any time via the Billing dashboard. Upon cancellation, your paid features will remain active until the end of your current billing cycle, after which your account will downgrade to the free tier.
• Refunds: Unless required by law, subscription fees are non-refundable.

4. Intellectual Property & Ownership

• Your Content: You retain ownership of the original text prompts, branding logos, and custom media files you upload. You grant EntrepriseSite a non-exclusive license to host, transmit, and display your websites to deliver the service.
• Platform IP: The Platform structure, editor interface, layouts, themes, database logic, and source code are the proprietary intellectual property of EntrepriseSite. You are granted a limited, non-transferable license to host your generated website on our hosting infrastructure.
• Image Licensing: Standard stock photos loaded during generation are sourced from public platforms like Unsplash and are subject to their respective terms.

5. Prohibited Uses

You agree not to use the Platform or generated websites to:

• Publish illegal, deceptive, harassing, defamatory, or harmful content.
• Engage in spam, phishing schemes, or transmit malicious code.
• Circumvent subscription tier limits or attempt to compromise Platform security.

6. Limitation of Liability & Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. ENTREPRISESITE DISCLAIMS ALL LIABILITY FOR DOWNTIME, DATA LOSS, COMPLIANCE ISSUES, OR BUSINESS LOSSES RESULTING FROM AI-GENERATED CONTENT OR PLATFORM OUTAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE SUBSCRIPTION FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

7. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction where EntrepriseSite resides, without regard to its conflict of law principles.
